1. APPLICABILITY
a. Processing Activities Covered by this Policy
This Policy applies to the processing of Personal Information collected by us when you:
- Visit our website (predictview.com) (the “Website”);
- Receive communications from us or otherwise communicate with us, including emails, phone calls, texts or faxes;
- Use our Services where we act as a controller of your Personal Information;
- Act as or work for a service provider or supplier to PredictView, to the extent PredictView acts as a controller with respect to your Personal Information;
- Are employed by a customer of our Services where your information has been shared with us in our capacity as a controller (for example, during the contracting process); or
- Participate in surveys, research or other similar data collection facilitated by us.
b. Third Parties
For applications, connectors or other solutions that are provided by third parties, the privacy policy of the third party applies, and this Policy does not. Our Website and Services may contain links to other websites, applications, platforms and services maintained by third parties. The information practices of these third parties are governed by the third party’s privacy statements and we advise you to refer to the policy statements of these third parties to understand how they collect and use information.
In some circumstances, we also collect, or our partners provide us with, publicly available information which may contain Personal Information that you have published or that has been made available online. The way in which our partners collect this is detailed in their own privacy policies, available on their websites.
c. Customer Data
We may process Personal Information submitted by or for a customer to our Services (“Customer Data”). To this end, we process such Personal Information as a processor on behalf of our customer who is the controller of the Personal Information under PredictView’s Master Subscription Agreement (or other such titled written or electronic agreement addressing the same subject matter) for the purchase of the Services (“MSA”).
This Policy does not apply to Customer Data. For detailed privacy information related to a PredictView customer who uses PredictView’s Services as the controller, please contact our customer directly. We are not responsible for the privacy or data security practices of our customers, which may differ from those explained in this Policy. d. Cookie Data
PredictView’s Cookie Policy is a separate notice about how and why we collect, use, disclose and otherwise process information that may be collected from you through cookies and other tracking technologies (collectively, “cookies”) when you use the Website or our Services. In our Cookie Policy, we also identify your options regarding the use of cookies and the information collected through cookies. The PredictView Cookie Policy does not apply to any third-party site that may be linked on our Website or our Services. 2. WHAT PERSONAL INFORMATION DO WE COLLECT DIRECTLY FROM YOU?
We may collect Personal Information directly from you in the following situations:
a. When You Communicate or Interact with Us
We may collect your contact information (e.g., name, job title, company name, address, phone number, email address) (“Contact Information”) and other information you voluntarily chose to share with us if you express an interest in obtaining additional information about our Services; use our “Contact Us” or similar features; communicate with us via a phone call; participate in a survey; use our Services; request customer support; register to receive communications; download certain content; or are employed by a customer of our Services where your information has been shared with us.
b. When You Visit or Interact with our Website or Services
We may collect information about your device and your usage of our Website or Services (e.g., IP address or other identifiers), which may qualify as Personal Information, using log files, cookies, web beacons or similar technologies if you interact with our Website or use our Services. c. When You Participate in Our Surveys, Research or Similar Activities
We may collect your Contact Information and other information you voluntarily chose to share with us in connection with your voluntary participation in surveys, research, responding to questionnaires or other similar data collection facilitated by us.
d. When You Are Our Supplier or Service Provider
We may collect your Contact Information, payment and billing information if you are a supplier or service provider to PredictView (or work for a PredictView supplier or service provider).
e. When You Make Purchases
We may collect your Contact Information and financial and billing information (such as billing name and address, credit card number or bank account information) if you make purchases via our Websites or subscribe to our Services.
f. When You Use our Services
We may collect your Contact Information, location information and user profile information voluntarily provided by you, if you use our Services where we act as a controller of your Personal Information. The does not include Customer Data (see Section 1(c) “Customer Data” above).
3. WHAT PERSONAL INFORMATION DO WE COLLECT FROM OTHER SOURCES?
In some circumstances, we collect, or our partners provide us with, publicly available information which may contain Personal Information that you have published or that has been made available online (such as when using social media sites). We may combine this information with Personal Information provided by you or our customers. The way in which our partners collect this is detailed in their own privacy policies, available on their websites.
In addition, another individual at your organization may provide us with your Personal Information, to the extent you consent to providing it and sharing it, for the purposes of obtaining services.
4. PURPOSES – WHAT DO WE USE YOUR PERSONAL INFORMATION FOR?
We may collect and process your Personal Information in the following situations:
a. Our Website
When you visit, navigate or interact with our Website or Services, we collect and process your Personal Information for the following purposes and rely on the following legal bases:
- Providing our Website. To provide, administer, maintain, manage and support our Website, which includes operating and administering our Website, diagnosing technical problems providing you with the content you access and request and tailoring the content and information that we may send or display to you. We have a legitimate interest in providing online content to our customers and prospective customers regarding our service offering and related information.
- Improving our Website. To analyze overall trends and help us improve the visitor and user experience on our Website. We have a legitimate interest in providing a relevant and well-functioning Website for the benefit of our Website visitors.
- Promoting the Security of our Websites: Tracking use of our Website and Services and verifying and investigating activity. We have a legitimate interest in promoting the safety and security of PredictView, our Website and our Services generally and to protect our rights and the rights of others.
b. Communications
When you receive communications from us or otherwise communicate with us, we collect and process your Personal Information for the following purposes and rely on the following legal bases:
- Sending Communications: To send you marketing information, product recommendations and other non-transactional communications about us (e.g., marketing newsletters, calls, information about our Services, to tailor the content and information that we may send or display to you). We have a legitimate interest in conducting direct marketing or where you have provided your prior consent (please see Section 11 below to learn how you can control the processing of your Personal Information by PredictView for marketing purposes).
- Recording Phone Calls: To record phone calls (in accordance with applicable laws) for training, quality assurance, and administration purposes. If required under applicable law, we will give you the option to object to a call being recorded. We are relying on consent or our legitimate interest in having high quality phone calls with our customers and prospective customers.
- Handling Contact and User Support Requests: To handling your request if you fill out a “Contact Me” web form or request user support, or if you contact us by other means including but not limited to via phone. This is necessary for the performance of a contract or our legitimate interest in fulfilling your requests and communicating with you.
c. Our Services
When you use our Services where we act as a controller of your Personal Information, we collect and process your Personal Information for the following purposes and rely on the following legal bases:
- Perform under the MSA: To perform our contract with our customers for the provision of our Services to satisfy our obligations under the contract with our customers. This includes assessing and managing usage and licensing compliance with the MSA and handling user support requests. This is necessary for the performance of a contract or our legitimate interest to provide, manage and administer our Services.
- Provide the Services: To provide, support, maintain, optimize and improve our Services, including to diagnose and respond to technical or service problems and to analyze overall trends and help us improve the user experience of our Services. We have a legitimate interest to ensure that our Services are performing in line with customer expectations, offer innovative services to our users and customers, and providing a relevant and well-functioning Services for the benefit of our users; if special categories of Personal Information are processed, where the Personal Information is made public by the data subject.
- Billing: To bill our customers for our Services and manage customer accounts generally. This is necessary for the performance of a contract or our legitimate interest in the management of customer accounts.
- Internal Reporting: For internal reporting purposes (e.g., forecasting, revenue, capacity planning, product strategy, financial reporting, etc.). We have a legitimate interest in the management of our business operations.
- Security: To maintain our own security, including for authentication purposes and investigating, detecting and preventing suspicious activity, fraud and cybercrime that may affect us or our Services. We have a legitimate interest in promoting the safety and security of PredictView and our Services generally and to protect our rights and the rights of others.
- Notifications. To send you requested relevant notifications (including emails or SMS messages). The legal basis for this processing is consent. You can unsubscribe at any time (see Section 11 below).
- Compensation: To determine compensation for our employees, such as commission. This is necessary for the performance of a contract with an employee or our legitimate interest in compensating our employees.
- Aggregated Data: To aggregate data to ensure that it is no longer relates to an identified or identifiable individual. We have a legitimate interest in minimizing the amount of Personal Information processed.
d. Other Personal Information Collection
We collect and process your Personal Information for the following purposes and rely on the following legal bases:
- Compliance with Legal Obligations: When cooperating with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws to the extent this requires the processing or disclosure of Personal Information to protect our rights. Relying on our legal obligation or our legitimate interest in protecting against misuse or abuse of our websites or services, protecting personal property or safety, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes, responding to lawful requests, or for auditing purposes.
- Surveys, Research or Similar Activities: To meet the goals set out in surveys or research as well as to analyze our compliance with internal policies. Relying on consent (if required under applicable law) or our legitimate interest in conducting the survey, questionnaire or research based on its stated goals (where no special categories of Personal Information are in scope). For example, filling out a survey about your user experience of our Services.
- Managing Payments: To process your Personal Information to verify that information and to collect payments if you have provided financial information to us, but only to the extent that doing so is necessary to complete a transaction and perform our contract with you. This is necessary for the performance of a contract.
5. WHO DO WE SHARE YOUR PERSONAL INFORMATION WITH?
We may share your Personal Information as follows:
- Service Providers, Contractors and Agents. With our contracted service providers, contractors and agents who provide services such as IT and system administration and hosting, billing, internet and connectivity, credit card processing, research and analytics, customer support and security for the purposes and pursuant to the legal bases described above in Section 4 (Purposes – What Do We Use Your Personal Information For?).
- Professional Advisors. In individual instances, we may share your Personal Information with professional advisors (including lawyers, bankers, auditors and insurers) who provide consultancy, banking, legal, insurance and accounting services, and to the extent we are legally obligated to share or have a legitimate interest in sharing your Personal Information.
- Affiliated Customer. If you use our Services as an authorized user, we may share your Personal Information with your affiliated customer responsible for your access to the Services to the extent this is necessary for verifying accounts and activity, investigating suspicious activity, or enforcing our terms and policies.
- Corporate Transactions. If we are acquired by or merged with another company, if we are involved in a reorganization or other fundamental corporate change, or if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the Personal Information we have collected to the other company.
- In Response to Legal Process. In order to comply with the applicable laws, or a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena or to meet national security or law enforcement requirements.
- To Protect Us and Others. Where we believe it is necessary in order to investigate, prevent or take action regarding actual or suspected illegal activities, violations of any contract or policy, or as evidence in litigation in which PredictView is involved.
- Anonymous and De-Identified Information. We may share anonymous or de-identified information about users or their use of our Services with third parties for the purpose of helping PredictView with analysis and improvements. Additionally, PredictView may share such anonymous or de-identified information about users or their use of our Services on an aggregate basis in the normal course of operating our business (e.g., we may share information publicly to show trends about the general use of our Services).

6. HOW DO WE SECURE YOUR PERSONAL INFORMATION?
We use a variety of security technologies and procedures to help protect your Personal Information from unauthorized access, use or disclosure. We secure the Personal Information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. All Personal Information is protected using physical, technical and organizational measures designed to safeguard against the accidental or unlawful destruction, loss, alteration and unauthorized disclosure of, or access to, the Personal Information we process or use. Please note that no system is completely secure. While we strive to protect your Personal Information, we cannot guarantee that unauthorized access, hacking, Personal Information loss or a data breach will never occur.

7. HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?
We may retain your Personal Information for a period of time consistent with the purpose of collection (see Section 4 (Purposes – What Do We Use Your Personal Information For?) or as long as required to fulfill our legal obligations. We determine the appropriate retention period for Personal Information on the basis of the amount, nature, and sensitivity of the Personal Information being processed, the potential risk of harm from unauthorized use or disclosure of the Personal Information, whether we can achieve the purposes of the processing through other means, and on the basis of applicable legal requirements.
After expiry of the applicable retention periods, your Personal Information will be deleted. If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will implement appropriate measures to prevent any further use of such data.
8. WHAT ABOUT INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION?
Your Personal Information may be collected, transferred to and stored by us or by a third party disclosed in Section 5 (Who Do We Share Your Personal Information With?), outside of your home jurisdiction, including, without limitation, in the United States where our office is located. These countries may not have the same data protection laws as the country from which you provide your Personal Information. PredictView only transfers Personal Information to another country in accordance with applicable data protection laws and if there is an adequate level of data protection in place for such transfer of your Personal Information. We will ensure your Personal Information is treated in accordance with this Policy wherever we process it.
9. DO WE RESPOND TO “DO NOT TRACK REQUESTS”?
Certain web browsers have incorporated a “Do Not Track” feature. This feature, when turned on, sends a preference to the websites you visit indicating that you do not wish to be tracked. Those sites (or the third-party content on those sites) may continue to engage in activities you might view as tracking even though you have expressed this preference, depending on the sites’ privacy practices. Because there is not yet a commonly-accepted standard on how to interpret Do Not Track requests, PredictView does not currently respond to browser Do Not Track requests on its websites or online services.
10. WHAT ARE YOUR RIGHTS?
You may have certain rights relating to your Personal Information, subject to local data protection laws. We have provided a summary below, but since some of the rights are complex, not all of the details have been included. We encourage you to read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights. Depending on the applicable data protection laws these rights may include the right to:
- Access your Personal Information held by us,
- Know more about how we process your Personal Information,
- Rectify inaccurate Personal Information and, taking into account the purpose of processing the Personal Information, ensure it is complete,
- Erase or delete your Personal Information, subject to certain exceptions,
- Restrict our processing of your Personal Information (e.g., limit the use or disclosure of “sensitive personal information” as defined in the CCPA),
- Transfer your Personal Information to another controller, to the extent possible,
- Object to any processing of your Personal Information,
- Opt-out of certain disclosures of your Personal Information to third parties (e.g., opt-out of “selling” or “sharing” of Personal Information as those terms are defined in the CCPA),
- If you’re under the age of 16, or such other applicable age of consent for privacy purposes in relevant individual jurisdictions, opt-in to certain disclosures of your Personal Information to third parties,
- Not be discriminated against for exercising your rights described above,
- Not be subject to a decision based solely on automated processing, including profiling, which produces legal effects (Automated Decision-Making), and
- Withdraw your consent at any time (to the extent we base processing on consent), without affecting the lawfulness of the processing based on such consent before its withdrawal.

We respond to all legitimate requests within a reasonable timeframe consistent with applicable data protection laws unless otherwise required by law. To the extent permitted under applicable law, we will contact you if we need additional information from you in order to honor your request or verify your identity.
You may authorize another person (your “agent”) to submit a request on your behalf. If an authorized agent will be submitting a request for you, please contact us by using the information in the “Contacting PredictView” section below. Please note that we are required to verify that your agent has been properly authorized to request information on your behalf (e.g., by asking your agent to provide us with a copy of your written authorization designating them as your authorized agent) and this may take additional time to fulfill your request.
You may unsubscribe from our marketing communications by either clicking on the “unsubscribe” link located at the bottom of our e-mails; updating your communication preferences; or contacting us using the information in the “Contacting PredictView” section below. Please note that opting-out of marketing communications does not affect your receipt of business communications that are important to your interaction with PredictView, such as communications about your subscription to our Services, announcements about our Services, customer support communications, security updates and account management communications.
If you are an employee of a PredictView customer, we recommend you contact your employer’s system administrator for assistance in accessing, correcting, updating or deleting your Personal Information.
Some registered users of our Services may update their user settings and profiles by logging into our Services and editing their settings or profiles.

If your Personal Information is contained in Customer Data (as defined in Section 1(c) above) and you wish to exercise any rights you may have under applicable data protection laws, please inquire with them directly because we may only access a customer’s data upon their instructions.
If you believe that we have not been able to assist with your complaint or concern, and you are located in the European Economic Area or the United Kingdom, you have the right to lodge a complaint with the competent supervisory authority. 12. OTHER IMPORTANT PRIVACY INFORMATION
a. “Selling” and “Sharing” under the CCPA
The California Consumer Privacy Act of 2018 (“CCPA”) requires businesses to disclose whether they “sell” or “share” Personal Information to any third party, as those two terms are defined in the CCPA. As a business covered by the CCPA, we do not “sell” or “share” Personal Information to any third party.
We may disclose your Personal Information with third parties or allow them to collect your Personal Information if those third parties are authorized service providers, contractors or business partners who require your Personal Information for the purposes described in this Policy and who have agreed to our contractual limitations as to their retention, use, and disclosure of your Personal Information, or if you use our sites, services or systems to interact with third parties or direct us to disclose your Personal Information to third parties. See Section 5 (Who Do We Share Your Personal Information With?).
b. Categories of Personal Information
The CCPA requires that we detail the categories of Personal Information that we disclose for certain “business purposes.” We disclose the following categories of Personal Information for our business purposes: Identifiers (e.g., name or e-mail address); Commercial information (e.g., subscription records); Internet activity information (e.g., browsing and search history); Geolocation data (e.g., IP address); Financial information (e.g., payment information); Professional and employment-related information; and Education information (e.g., job history).
The business and commercial purposes for which we collect this information are described in Section 4 (Purposes – What Do We Use Your Personal Information For?). The categories of third parties to whom we “disclose” this information for a business purpose are described in Section 5 (Who Do We Share Your Personal Information With?).
c. Shine the Light
California law permits residents of California to request certain details about what Personal Information a company shares with third parties for the third parties’ direct marketing purposes.
PredictView does not share your Personal Information with third parties for the third parties’ own and independent direct marketing purposes. If you have any questions about what Personal Information PredictView may share with third parties that are not already answered in this Policy, please contact PredictView at: privacy@predictview.com.
d. Information About Children
Our Website and Services are not directed at children. We do not knowingly collect Personal Information from children under the age of 16, unless (a) we have obtained consent from a parent or guardian, (b) such collection is subject to a separate agreement with us or (c) the visit by a child is unsolicited or incidental. If you are a parent or guardian and believe your child has provided us with Personal Information without your consent, please contact us by using the information in the “Contacting PredictView” section below and we will take steps to delete their Personal Information from our systems.
e. If You Provide Us Personal Information
If you provide us or our service providers with any Personal Information relating to other individuals, you represent that you have the authority to do so, and where required, have obtained the necessary consent, and acknowledge that it may be used in accordance with this Policy. If you believe that your Personal Information has been provided to us improperly, or want to exercise your rights relating to your Personal Information, please contact us by using the information in the “Contacting PredictView” section below.
13. CHANGES TO THIS POLICY
PredictView reserves the right to change this Policy as necessary or advisable to accommodate changes to the law, technology, our operations, our privacy practices or other circumstances.
